Title Insurance

     Brabazon Law Office, LLC offers a full range of title insurance, closing, and abstract services for both residential and commercial real estate transactions. We underwrite title insurance for residential and commercial sales, refinancing, and construction loans through Attorney’s Title and Guaranty Fund, Inc. (“ATG”), one of the most respected providers of title insurance in the Midwest. We also assist our clients by acting as the closing attorney and disbursing agent for construction loans.

     Title insurance is an indemnity against financial loss arising from defects in the title to real estate, as well as the invalidity or unenforceability of mortgages. Its purpose is to protect the owner’s and the lender’s financial interest in the property against losses arising from certain title defects. As in other types of insurance, the issuer of the title insurance policy has a duty to defend the policy holder (in this case against lawsuits threatening title to the property), and to reimburse the owner for monetary losses arising from defects covered under the policy.

     Title insurance has become a standard part of both residential and commercial real estate transactions in Wisconsin. The standard form real estate offers to purchase used in Wisconsin all contain provisions requiring that the seller provide evidence of good and merchantable title to the real estate as a condition of closing. Generally, a title search will be conducted on the property, and a title commitment issued to the buyer in advance of the closing.
